🏔️ Yukon — Co-Development

The Yukon has taken the BC model further with a co-development approach — new mining legislation is being built jointly with First Nations governments.

⚠️ Mexico: Legislation Without Rule of Law Is Not Enough

Mexico reformed its Mining Law in May 2023, incorporating mandatory prior consultation with Indigenous and Afro-Mexican communities (Art. 6°), 5% of net profits paid to affected communities, social impact assessments, and ILO Convention 169 ratification. On paper, Mexico adopted key elements of the model.

But legislation without rule of law failed:

  • 10 miners from Vizsla Silver (Canadian) kidnapped and ALL found dead in mass graves — Sinaloa, Jan-Feb 2026
  • 3 miners killed in Concordia, Sinaloa (June 2025)
  • San Rafael mine (Canadian) halted due to insecurity (Feb 2025)
  • Local management had prior dealings with armed cartel group (CBC, Feb 2026)
  • Mining production contracted 17.6% year-over-year

Why the reform wasn't enough:

  • Without rule of law, laws go unenforced — cartels fill the governance vacuum
  • Mines sit near populations vulnerable to organized crime — no geographic isolation
  • No actual tri-partite alliance was created — just law on paper, no institutional structure
  • Fear of retaliation prevents formal complaints
  • New concessions frozen since 2018 — legal uncertainty drives miners to informal deals

📌 Lesson: The alliance model works where there is rule of law and mines are remote from rogue populations — up high, in isolated zones, as in Chile. A legal framework without enforcement capacity is just paper.

🇨🇱 Chile: The Opportunity — First-Mover Advantage

Chile is Latin America's #1 mining investment destination ($833M exploration budget, 4th globally) with stable governance, free trade agreements with the US, and the new LMAS 2025 permitting reforms. Unlike Mexico, Chile has: functioning rule of law, mines at altitude and in remote zones, and institutions that follow through. But a critical gap remains:

Ratified but inconsistently applied. Supreme Decree 66 exists but courts lack unified standard.

Atacameño, Aymara, Diaguita, Mapuche, Colla, Quechua — all affected by mining operations.

Unlike BC/Yukon, Chile has no structured tri-partite partnership. Miners negotiate alone.

Active conflicts demonstrate the need: Atacameño communities are negotiating directly with SQM and Albemarle over lithium expansion in the Atacama Salt Flats (2025-2060 CORFO contracts). The Diaguita people stopped Barrick Gold's Pascua Lama — one of the world's largest gold mines. These conflicts cost billions. An alliance prevents them.

💼 Business Model — In Development

The Canadian model (BCMA) operates on industry membership, government funding, and conference sponsorship. It does not publish exact fees, but comparable mining associations (AME BC, MAC) charge CAD$1,000–$25,000+/year depending on company size. Our approach is to facilitate the creation of a similar Chilean alliance, not to copy Canadian pricing.

Who pays? Model options:

Option A: Mining Association

A Chilean mining chamber (like SONAMI or CMinera) hires us to design and launch the alliance. Funded via member dues.

Option B: Junior Miner Consortium

A group of junior exploration companies (TSXV/CSE with concessions in Chile) jointly fund the alliance to reduce their community risk.

Option C: Government + Industry

Hybrid model: CONADI or Ministry of Social Development co-funds with industry. Closest to the actual Canadian model.

⚠️ Mexico: Legislation Without Rule of Law Is Not Enough

Mexico reformed its Mining Law in May 2023, incorporating mandatory prior consultation with Indigenous and Afro-Mexican communities (Art. 6°), 5% of net profits paid to affected communities, social impact assessments, and ILO Convention 169 ratification. On paper, Mexico adopted key elements of the model.

But legislation without rule of law failed:

  • 10 miners from Vizsla Silver (Canadian) kidnapped and ALL found dead in mass graves — Sinaloa, Jan-Feb 2026
  • 3 miners killed in Concordia, Sinaloa (June 2025)
  • San Rafael mine (Canadian) halted due to insecurity (Feb 2025)
  • Local management had prior dealings with armed cartel group (CBC, Feb 2026)
  • Mining production contracted 17.6% year-over-year

Why the reform wasn't enough:

  • Without rule of law, laws go unenforced — cartels fill the governance vacuum
  • Mines sit near populations vulnerable to organized crime — no geographic isolation
  • No actual tri-partite alliance was created — just law on paper, no institutional structure
  • Fear of retaliation prevents formal complaints
  • New concessions frozen since 2018 — legal uncertainty drives miners to informal deals

📌 Lesson: The alliance model works where there is rule of law and mines are remote from rogue populations — up high, in isolated zones, as in Chile. A legal framework without enforcement capacity is just paper.

🇨🇱 Chile: The Opportunity — First-Mover Advantage

Chile is Latin America's #1 mining investment destination ($833M exploration budget, 4th globally) with stable governance, free trade agreements with the US, and the new LMAS 2025 permitting reforms. Unlike Mexico, Chile has: functioning rule of law, mines at altitude and in remote zones, and institutions that follow through. But a critical gap remains:

Active conflicts demonstrate the need: Atacameño communities are negotiating directly with SQM and Albemarle over lithium expansion in the Atacama Salt Flats (2025-2060 CORFO contracts). The Diaguita people stopped Barrick Gold's Pascua Lama — one of the world's largest gold mines. These conflicts cost billions. An alliance prevents them.

💼 Business Model — In Development

The Canadian model (BCMA) operates on industry membership, government funding, and conference sponsorship. It does not publish exact fees, but comparable mining associations (AME BC, MAC) charge CAD$1,000–$25,000+/year depending on company size. Our approach is to facilitate the creation of a similar Chilean alliance, not to copy Canadian pricing.

Who pays? Model options:

Option A: Mining Association

A Chilean mining chamber (like SONAMI or CMinera) hires us to design and launch the alliance. Funded via member dues.

Option B: Junior Miner Consortium

A group of junior exploration companies (TSXV/CSE with concessions in Chile) jointly fund the alliance to reduce their community risk.

Option C: Government + Industry

Hybrid model: CONADI or Ministry of Social Development co-funds with industry. Closest to the actual Canadian model.
